GENERAL TERMS AND CONDITIONS SENTO MODO

Article 1 – Definitions

In these general terms and conditions, the following terms are used with the following meanings:

  • Sento Modo: the trading name of the sole proprietorship registered with the Chamber of Commerce under number 83863214, VAT number NL003883543B02, established in Angstel, Rotterdam, the Netherlands.
  • Customer: the natural person or legal entity entering into an agreement with Sento Modo.
  • Webshop: the online store of Sento Modo, accessible via www.sentomodo.com.
  • Products: the garments and accessories with personalised prints offered by Sento Modo through the webshop.
  • Agreement: any arrangement or agreement between Sento Modo and the customer.

Article 2 – Applicability

2.1 These general terms and conditions apply to all offers, orders and agreements between Sento Modo and the customer.

2.2 By placing an order, the customer accepts these general terms and conditions.

2.3 Deviations from these terms and conditions are only valid if expressly agreed upon in writing.


Article 3 – Offers and products

3.1 All offers in the webshop are non-binding. Sento Modo reserves the right to change products and prices.

3.2 All products are manufactured on a print-on-demand basis. This means that products are only produced after the order has been received.

3.3 The images and specifications of products in the webshop are displayed as accurately as possible. However, minor deviations in colour and design may occur as a result of screen settings and the production process.

3.4 Sento Modo cannot guarantee that the display of designs on different products is exactly identical, given the different materials and production techniques.


Article 4 – Formation of the agreement

4.1 The agreement is concluded at the moment the customer has completed the order and payment has been received.

4.2 Upon receipt of the order, the customer will receive an order confirmation by email. This confirmation contains the order details and estimated delivery time.

4.3 Sento Modo reserves the right to refuse orders or to attach additional conditions to delivery.


Article 5 – Prices and payment

5.1 All prices in the webshop are in euros and include VAT, unless stated otherwise.

5.2 Shipping costs are calculated separately and clearly stated before completing the order.

5.3 Payment must be made via the payment methods offered in the webshop.

5.4 In the event of late payment, the customer is in default by operation of law and Sento Modo reserves the right to cancel the order.


Article 6 – Delivery and delivery times

6.1 Products are delivered worldwide via our fulfilment partner.

6.2 Because all products are made to order, the estimated production time is 2–7 business days, after which the product is shipped.

6.3 The total delivery time depends on the production time plus the shipping time to the specified address:

  • Netherlands/Belgium: 3–5 business days after production
  • Rest of Europe: 5–10 business days after production
  • Worldwide: 10–20 business days after production

6.4 The stated delivery times are indicative. Sento Modo is not liable for delays in production or shipping.

6.5 The risk of loss or damage passes to the customer at the moment the product is delivered to the customer or a representative designated by the customer.

6.6 The customer is required to provide the correct and complete delivery address. Sento Modo is not liable for delay or non-delivery due to incorrect address details.


Article 7 – Right of withdrawal (14-day cooling-off period)

7.1 Consumers have the right to dissolve the agreement within 14 days of receiving the product without giving reasons (statutory right of withdrawal).

7.2 PLEASE NOTE: Because all products are personalised and made to order, the right of withdrawal is EXCLUDED for:

  • Products manufactured according to the customer's specifications (custom designs)
  • Products that cannot be returned by their nature
  • Sealed products that have been opened after delivery

7.3 If the right of withdrawal applies, the customer must notify us in writing within 14 days of receipt via info@sentomodo.com.

7.4 The customer must return the product within 14 days of notification, unused, in its original condition and packaging. Return shipping costs are at the customer's expense.

7.5 Upon approval of the returned product, the customer will receive the amount paid (excluding shipping costs) back within 14 days.


Article 8 – Warranty and complaints

8.1 Sento Modo guarantees that the products meet the specifications stated in the webshop and the requirements that may reasonably be imposed regarding quality and usability.

8.2 The warranty period is 2 years from the date of delivery, in accordance with EU legislation.

8.3 Complaints about products must be reported in writing within 30 days of discovery via info@sentomodo.com, stating:

  • Order number
  • Clear description of the defect
  • Photos of the defect

8.4 In the event of a valid complaint, Sento Modo has the choice to:

  • Replace the product free of charge, or
  • Refund the purchase price

8.5 Production error or defect: If the product contains a production or material defect, the product will be replaced free of charge and any return shipping costs will be reimbursed.

8.6 Not considered a defect: Minor variations in colour, print position or material texture that are inherent to the print-on-demand process.

8.7 The warranty lapses if:

  • The product has not been cared for in accordance with the care instructions
  • The product has been damaged through improper use
  • The customer has made modifications to the product themselves

Article 9 – Liability

9.1 Sento Modo is only liable for direct damages that are demonstrably the result of an attributable failure.

9.2 Liability for indirect damages, including consequential damages, loss of profit, missed savings and damages due to business interruption is excluded.

9.3 Liability is limited to the amount of the order, with a maximum of €500.

9.4 Sento Modo is not liable for damages arising from:

  • Incorrect or incomplete information provided by the customer
  • Delays or errors in the production or shipping process at our fulfilment partner
  • Actions of third parties (such as delivery services)

Article 10 – Intellectual property

10.1 All intellectual property rights to designs, images, logos and other content on the webshop are held by Sento Modo or the authorised licensors.

10.2 It is not permitted to copy, distribute or otherwise use content from the webshop without prior written consent.

10.3 The customer guarantees that any content they submit does not infringe upon the rights of third parties.

10.4 ANIME-INSPIRED DESIGNS: The logos and designs on our products are inspired by anime styles, fighting movements and aesthetics, but are NOT literal reproductions of existing anime characters or brands. Our designs are original interpretations and artistic creations inspired by anime culture and the fighting spirit.

10.5 If you believe that a design or logo on our webshop infringes intellectual property rights or is otherwise inappropriate, we request that you report this via info@sentomodo.com. We will treat such reports seriously and, if necessary, remove the relevant products and designs.


Article 11 – Privacy and data protection

11.1 Sento Modo processes personal data in accordance with the General Data Protection Regulation (GDPR).

11.2 Personal data is only used for:

  • Processing and delivering orders
  • Communication regarding orders and customer service
  • Improving the webshop and services

11.3 Data is shared with our fulfilment partner (Printful) solely for the production and shipping of orders.

Article 12 – Force majeure

12.1 Sento Modo is not obliged to fulfil any obligation if it is prevented from doing so as a result of force majeure.

12.2 Force majeure is understood to mean: circumstances beyond the will and control of Sento Modo that permanently or temporarily prevent the fulfilment of obligations, including disruptions in production or shipping at our fulfilment partner, internet outages, strikes, fire and government measures.


Article 13 – Disputes and applicable law

13.1 All agreements between Sento Modo and the customer are governed exclusively by Dutch law.

13.2 Disputes will preferably be resolved through mutual consultation.

13.3 To the extent not otherwise prescribed by mandatory law, disputes will be submitted to the competent court in the district where Sento Modo is established.

13.4 Consumers may also make use of the disputes committee or the European ODR platform (http://ec.europa.eu/odr).


Article 14 – Final provisions

14.1 These general terms and conditions may be amended at any time. Amendments take effect from the date of publication on the webshop.

14.2 Orders placed before the date of amendment remain subject to the previous terms and conditions.
